Your duties
The Fire Safety Order and the responsible person
In England and Wales the main fire safety law is the Regulatory Reform (Fire Safety) Order 2005. It applies to almost every non-domestic building and to the communal parts of blocks of flats.
The Order puts the duty on the responsible person, usually the employer, building owner or whoever has control of the premises. It also expects the fire risk assessment to be carried out by someone competent. We help you meet that bar, whether by doing the work ourselves or supporting the people who do.
As the responsible person, you must:
- Carry out a suitable and sufficient fire risk assessment
- Put the right fire precautions in place
- Keep them under review
What changed in 2023
Fire safety law has tightened since Grenfell
Three pieces of legislation have reshaped fire safety duties and one change in particular catches a lot of businesses out.
- 2021
Fire Safety Act 2021
Clarified that the Order covers a building’s structure, external walls and flat entrance doors.
- 2022
Fire Safety (England) Regulations 2022
Introduced new duties in multi-occupied residential buildings, from information to wayfinding signage.
- 2022
Building Safety Act 2022
Amended the Order through Section 156 and created a new regime for higher-risk buildings.
Every responsible person must now record in full
Every responsible person must record their fire risk assessment in full and record their fire safety arrangements, whatever the size or type of the premises. The old rule, where only businesses with five or more employees had to write things down, no longer applies to fire. If you run a small business and assumed you were exempt, you are almost certainly not.
There are also stronger duties to cooperate where a building has more than one responsible person, duties to give residents fire safety information in blocks of flats and increased penalties for getting it wrong. We help you make sense of all of it and put it right.
