Education Health and Safety
An education site is a workplace full of people who never chose to be there and were never trained in its hazards, housed in buildings often older than anyone employed to look after them. AL23 Safety helps schools, academy trusts, sixth form and further education colleges and universities manage the estate, the fire strategy and the daily operational risks across the UK.
Why it matters in education
The risks are real and so are the duties
The Health and Safety Executive is the enforcing authority for schools, academies, colleges and universities under the Health and Safety (Enforcing Authority) Regulations 1998. Fire and rescue authorities enforce the Regulatory Reform (Fire Safety) Order 2005 separately. Two regulators can arrive at the same site with different priorities. HSE ran a duty to manage asbestos inspection campaign across non-domestic premises including schools during Global Asbestos Awareness Week from 1 to 7 April 2026, looking for accurate identification of asbestos containing materials, a live management plan with condition monitoring and control of any work that could disturb them. Where a material breach is found, Fee for Intervention runs at £188 per hour from 1 April 2026.
The estate framework has also changed. The School Estate Management Standards launched in June 2025 and from autumn 2026 responsible bodies must submit an annual return self-assessing compliance against them. That covers local authorities, academy trusts, dioceses for voluntary aided schools and sixth form colleges. Individual schools and nurseries are exempt. Submissions open in the third week of September with a late November deadline. There is no funding consequence and no penalty for missing a standard, which makes the real risk publishing an honest return that shows gaps you have no plan to close. Good estate management for schools remains the operational guidance underneath it, updated in February 2025 to add flood risk.

Asbestos in the fabric
The regulation 4 duty to manage sits with the responsible body and the recurring inspection finding is a plan that exists on paper with no condition monitoring behind it.
Legionella in low use water systems
School systems sit stagnant through holidays with dead legs and rarely used outlets, which is why an absent flushing regime is one of the most common enforcement findings in the sector.
Design and technology and science
Machinery guarding and interlocks, fume cupboard extraction that has missed its thorough examination at 14 months and thin supervision ratios account for most curriculum injuries.
Falls from height
Roof access, stage and hall lighting rigs, caretaker ladder work and classroom display work produce a disproportionate share of serious injuries.
Contractor control during term time works
Capital and maintenance work in occupied buildings combines unfamiliar workers, opened compartments and safeguarding exposure in one place.
RAAC and structural condition
Reinforced autoclaved aerated concrete was confirmed in 237 schools and colleges in England, with a commitment that every one not being fully or substantially rebuilt will be RAAC-free by 2029. Structural condition still drives closures, decants and emergency propping.
The regulations that apply
Your legal framework, in plain terms
The Health and Safety at Work etc. Act 1974 and the Management of Health and Safety at Work Regulations 1999 set the baseline duty to assess risk and act on it. The School Premises (England) Regulations 2012 set minimum standards for the premises themselves, covering water supply, drainage, toilet and washing facilities, lighting, acoustics, heating and structural condition. Regulation 4 of the Control of Asbestos Regulations 2012 puts the duty to manage on whoever controls the premises. The Control of Substances Hazardous to Health Regulations 2002 catch science, art, cleaning and grounds chemicals and the Fire Safety Order covers fire. Licensable adventure activities for under 18s bring in the Adventure Activities Licensing Regulations 2004. For science and design and technology, CLEAPSS is the de facto standard through its model risk assessments, Student Safety Sheets, GL171 and G235 for design and technology and PS090 for recording risk assessments in science.
Two further frameworks shape how findings land. Keeping Children Safe in Education 2026 applies from 1 September 2026 and its estate touchpoints are site security, contractor vetting, lone working with pupils and off site visits. Ofsted moved to a renewed inspection framework from November 2025 with report cards and graded evaluation areas, with further updates from September 2026. Safeguarding is judged separately as met or not met. Estate failures surface there more often than anywhere else.
Fire safety in education
Old buildings and mundane defects on live estates
Building Bulletin 100, Design for fire safety in schools, still dates from 2007. The Department for Education consulted on a revised version between 27 May and 18 August 2021. The consultation page has read "We are analysing your feedback" since 17 August 2021 and no government response or revised bulletin has appeared. Sprinkler provision in new schools is therefore contested, decided project by project between the design team, the insurer and the fire and rescue service rather than by national guidance.
For existing buildings the position is firmer. Since section 156 of the Building Safety Act 2022 commenced on 1 October 2023 the fire risk assessment must be recorded in full whatever the size of the premises, along with the fire safety arrangements, the name and UK address of the responsible person and the identity of whoever carried it out. New build and major refurbishment follows Approved Document B alongside the Department for Education output specifications. On live estates the defects we find most often are mundane. Fire doors wedged open for circulation, compartment walls breached by data cabling installed years after handover, missing self closing devices and evacuation plans that assume every pupil can use a stair unaided.
Education premises also sit inside Martyn's Law. Under the Terrorism (Protection of Premises) Act 2025 childcare, primary, secondary and further education premises are capped at standard tier whatever their capacity. Higher education is not capped. A large university venue can reach the enhanced tier at 800 or more people. The duties are not yet in force and go live is expected in spring 2027, which is an expectation rather than a statutory date.
